Frequently Asked Questions

Do I need a solicitor?

If you have a question you can’t find here, please contact us directly for more information.

Do I need a solicitor?

You can apply for a divorce yourself in England and Wales, so you do not have to instruct a solicitor. MyDivorce gives you a choice of support depending on how much help you would like. If your situation involves complex finances, children or a disagreement, independent legal advice may be particularly helpful.

What if I get stuck?

You do not have to work everything out on your own. The help available depends on the package you choose, from a more independent process to guidance and hands-on support. If you think you will need help along the way, we can help you choose the right level of support before you begin.

How long does it take?

In England and Wales, a divorce normally takes at least around seven months from the date the court issues the application, and it can take longer. There is a minimum 20-week period before you can apply for a Conditional Order, followed by a further minimum of six weeks and one day before you can apply for the Final Order. Court processing times and any complications can affect the overall timescale.

Is this only for uncontested divorces?

MyDivorce is designed for people applying for a divorce under the no-fault system in England and Wales. You do not need to prove that either person was to blame. However, if your spouse disputes the court’s jurisdiction or the legal validity of the marriage, or if other complex issues arise, you may need specialist legal advice.

What about children or assets?

The divorce application legally ends your marriage, but it does not automatically resolve arrangements for children, property, pensions or other finances. MyDivorce can discuss child arrangements in an initial free consultation, with any further legal work charged separately. Financial orders and negotiations are not included in the divorce packages, so you may need separate advice to protect your position.

Do I need to complete any forms myself?

You will need to provide accurate information and any relevant documents so your application can be prepared. How much of the form-filling you do yourself depends on the package you choose. We explain what information is needed and what happens next, so you can select the level of assistance that suits you.

What if communication with my spouse is difficult?

You can usually make a sole divorce application without needing your spouse to agree to the divorce. The court will still normally need to notify them and give them an opportunity to respond. If you do not know their address, they are unresponsive or there are safety concerns, tell us before starting so we can explain the possible next steps and whether additional legal help may be needed.

Can you help if finances are involved?

We can help you understand how the divorce process fits alongside financial matters, but the divorce packages do not include negotiating a financial settlement or obtaining a financial order. It is important to deal with finances separately, ideally before the Final Order, and to seek tailored legal advice where needed.

Will I have a dedicated point of contact?

The contact and support you receive depend on your chosen package. Full Support offers more direct involvement from the MyDivorce team, while Guided and Independent are designed for different levels of assistance. We will make clear what is included before you purchase.

Can I upgrade later?

If you decide you need more support, contact us and we can discuss moving to a higher-support package. Any upgrade will depend on the stage your application has reached, the work already completed and the additional fee involved. We will explain your options before you decide.
